I think these costumes go hand in hand with character bouncers..... if they aren't "licensed" then they shouldn't be promoting the characters as they are. The business that have been in the inflatable industry know that we shouldn't be buying and promoting unlicensed character bouncers. Same should go for costumes. IMHO.

I think that slamming someone with that huge of a lawsuit instead of a cease-n-desist order is a harsh punishment thou....probably trying to make an example of her. :-(

Can anyone answer this..?
If I hire a clown to entertain at a party that I booked as a bouncer rental company owner. Do I get fined as well?

NO! Why would you be fined? You are simply contracting a service.

I personally think all of this is a load of crepe. If you can buy a costume at Party City, then it is legal. Of course, as a clown business, they better make proper arrangements before using them to make money. I swear at Halloween I see lots of characters that look like Barney, etc....

I think it is not fair, there is a lot of party stores, that sell more piñatas of spongebob, spiderman, bob the builder, ect.... they should start with them, there is a store in town that has more than 2000 piñatas in the store, and they are not licenced

I've always disliked unlicensed bounces. Had an unlicensed Power Puff Girls bounce about 10 years ago. When I bought out the other half of my company, first thing I did was remove the big character off it and made it generic (also added a slide). About 2 years after I did that I got a notice from the Power Puff license holder telling me that I was going to be sued. Simply stated that I no longer had the piece + it wasn't even on my website anymore and I never heard from them again. 

 

Whenever I receive an email from a company selling inflatables & I see unlicensed stuff, I delete it and never think twice. Its not worth dealing with in my book. I don't really do birthday parties though so I guess thats where those rent. -Mike
